Sayings of DonkeyHotey #19: When you stand on the property of another, you have fewer Constitutional Rights than when you are on public property or in your own home. For example, your freedom of speech and assembly can be limited by the rules of the owner of a restaurant, ball park or store. Your rights are limited at work. Many Republicans and Libertarians seek to privatize roads, schools, parks, the military and even government buildings. They consider it a worthy goal to shrink the commons and thus reduce government. In reality, this approach will eventually make irrelevant many rights under the Constitution, because there will be no place to exercise them. Thus, more private property equals less freedom or liberty.

We have moved into occupying digital spaces, but we have not carved out any area where we can exercise our constitutional rights without restrictions. Your rights are limited by the private owners of the infrastructure, devices and applications used to access and transmit data. You are bound by terms of service that limit your rights and these are enforced by overreaching laws like the DMCA and the CFAA. Intellectual property rights have been expanded in scope and terms lengthened to insure profits for rights holders well beyond those envisioned by the Framers of the Constitution.

There really needs to be an appropriate balance between property held in the commons and private property. The momentum in America is on the side of privatization. Only citizens acting in their true self interest can reverse this trend.
