Double standards on SanDisk Extreme Facebook page

kwongphotography posted a new topic:

Hi everyone,

I had a very disturbing experience on Facebook today that I thought some of you might find interesting.

I received a message from someone who frequents the SanDisk Extreme page on Facebook. This person asked that I post my images in another forum as it was "not the right forum here." This person went on to make a post on the page asking that I be banned from the page as my posts made her "not want to come to this page."

Each day for the past several weeks, I post a few links to the images I host here on Flickr. There are no nudes, sexually explicit or otherwise lewd images in my Photostream. The majority of the images I have posted are from sporting events, as it's the subject I shoot the most.

Quite frankly, I find it to be a bit two-faced for people to discourage sports images from being posted on a product site that markets heavily to the sports photography community while encouraging art photographers to share their pictures. SanDisk itself posts many sports and adventure images in the banner of the page including Terrell Lloyd's 49er playoff pictures.

I don't know if this individual has some personal problem with sports or not. If I'm banned -- I doubt I will be -- I'll definitely be dumping all of my SanDisk products.

Personally, I've always felt that art photographers have had a negative view of sports photographers. While I can't say for sure, it appears to me that they don't see sports shooters as "artists" even though there is an "art" to capturing great sports images.

I hope that none of you experience this kind of discrimination.

Reply to Check softballperformance.Com for unauthorized use of your images.

chemisti posted a reply:

I have worked out an agreement with the site owner. They are in the process of updating the site now.

However - there are many images there that are not mine. If you shoot softball, you might want to cruise through and see if they are using any of your images.

Strongly suspect that there is content there from Flickr.

Check softballperformance.Com for unauthorized use of your images.

chemisti posted a new topic:

My contact with owner/publisher ealier today:

Let me open by saying that I like your site and the articles shared there. I am particularly a fan of the images presented there – as I am the creator and owner (Chemisti user account on Flickr) of many of the images displayed there.

I would think that someone who provides digital training videos and aids to aspiring softball players would be very sensitive to unauthorized use of property without compensation.
For example, I’m reasonably sure that you would find it objectionable should I order your training aid videos and then copied them for all the members of my daughter’s team.

You also clearly expect some copyright protection yourself, as each page on the site has the following information posted in the footer:
“© 2000-2008 M.O. Dagenais & Associates, Inc. All Rights Reserved.
154 Charlotte St., Suite C508, Montreal, Quebec (Canada)
Telephone/Fax: 866-589-0439”

I have recently noted that several of my images are being used on the web site: www.softballperformance.com/

See attached examples in the pdf files included.

Each of the images used is covered by a version of a creative commons license exactly like or similar to this example (there have been some revisions to the license over time):
creativecommons.org/licenses/by-nc-nd/2.0/
and is clearly labeled as such on each of the respective images’ display pages on Flickr

See example here: www.flickr.com/photos/chemisti/639081052/in/set-721576005...

More information on Creative Commons Licensing here: creativecommons.org/

Clearly the site serves a commercial purpose:
www.softballperformance.com/irresistible/

The following images are mine (others on your site may also be mine – I just stopped at these):
www.softballperformance.com/wp-content/uploads/2010/12/27...

My objections:
1. softballperformance.com web presence clearly serves a commercial purpose – a violation of the licensing terms of use for the photos.
2. Images do not have attribution information (credits or ownership information) – a violation of the licensing terms of use for the photos..
3. Some of the images do not even “click through” to the original images posted on Flickr – they have been copied to the softballperformance web site, resized, and thus “altered” – another violation of the license terms.

You are hereby requested to:
1. Cease and desist from use of my property on your commercial web site, or
2. Ask for permission to use said images on your web site (per the license agreement) and if permission is granted, meet the other requirements of the licensing agreement.

Hi there,

I'm trying to spread the word about an auction Hockey Canada has on Ebay for a Team Canada Music Jewelry Box autographed by Hayley Wickenheiser, the MVP of Canada’s gold medal Olympic winning hockey team.

All net proceeds raised through the Team Canada 2008 IIHF World Junior Championship auction will go to Hockey Canada, to assist with the funding of national development programs, national teams and Hockey Canada initiatives that promote the sport at the grassroots level.

If you want to bid on this item, or know of someone who would, you can click on this link:

To view or bid on the item, please click on the following link:

search.ebay.com/search/search.dll?from=R40&_trksid=m3...

This auction ends soon and it is for a great cause, and of course it has one of the most famous Canadian Women in sport, Hayley Wickenheiser :)

Thanks alot all!

I've started a new group for photos of girls and women doing sports while wearing gender-specific clothing. By this I mean, for instance, runners wearing bun huggers (racing briefs) rather than shorts and tennis players in skirts.
