Here's a facinating story about a family photo being used without permission - luckily, it has as much a happy ending as I think could be possible:&lt;br /&gt;

Clearly you feel that the production company was in the wrong for using the photo of that man's grandmother without his permission and portraying her in a potentially negative light.  So how is that any different from Albert'sEYE using found vintage photos in the items he sells on his website?  I'm particularly fond of the &amp;quot;Booze and Pills&amp;quot; card with 2 children on the front...I'm sure they would LOVE to know that their personal snapshot was used in that way.  &lt;br /&gt;

Let's recap :&lt;br /&gt;
&lt;br /&gt;
#1 - Mean old men use a photo of a man's grandmother without his permission ... portraying her as the wife of a Nazi.  Boo! Hiss! This you disagree with, correct?&lt;br /&gt;

#2 - Grand and wonderful Albert'sEYE uses a photo of someone's children without their permission ... and references &amp;quot;Booze and Pills&amp;quot;.  Yay! Fantastic!  This you agree with, correct?&lt;/p&gt;</description>

&lt;p&gt;It's funny you should use the word &amp;quot;stolen&amp;quot; since the images don't actually belong to you.  You see, for unpublished material such as family snapshots, the copyright remains solely with the person who created the image.  They retain the copyright until their death plus an additional 50 years.  Thanks to a revision of the copyright law, the original photographer still retained their rights until 2003 (if the life + 50 year rule had already expired).  After this time the image entered the public domain.&lt;br /&gt;
&lt;br /&gt;
Keyword there is &amp;quot;public&amp;quot;.&lt;br /&gt;
&lt;br /&gt;
Anyhoo, it is obvious that *you* are not the creator of all the images in your store and therefore have no legal claim to run all over Flickr yelling &amp;quot;Thief&amp;quot;, &amp;quot;Scoundrel&amp;quot;, ...&amp;quot;Hideous Monster&amp;quot;.  &lt;br /&gt;
&lt;br /&gt;
Let's take one of the photos you've listed that was taken in the mid-1960's.  Its reasonable to assume that the photographer was a young man in his early 30s.  Now let's say he lived to be 70 (which means he died sometime around 2005.  He (or his family) would retain the rights to that photo he took way back in the 60s.  The photo that you now have scanned and uploaded to your eBay store.  Unless you received his permission to create a digital copy of his photo, you too have just become a &amp;quot;thief&amp;quot; and a &amp;quot;scoundrel&amp;quot;.  Shocking isn't it?!  And whereas  I simply uploaded photos to entertain and educate....YOU are the one who is uploading photos for commercial gain.  &lt;br /&gt;
&lt;br /&gt;
In fact, the Library of Congress clearly states that it does not own the copyrights for the materials in their collections, even though they scan and archive the items. Mere possession of a copy of an original work does not constitute ownership of that work's copyright. Actually....possession of the ORIGINAL work itself doesn't constitute ownership of the copyright.  So if anything we are equally at fault...although I like to think that since you're the one actually making money on the images you're a wee bit more guilty than I am. &lt;br /&gt;
&lt;br /&gt;
Oh..and for those who thanked Albert for the &amp;quot;heads up&amp;quot; - &amp;quot;heads up&amp;quot; for what exactly?  So you can shield your eyes from the images?  What are you on the lookout for?  Maybe so you won't purchase the &amp;quot;stolen&amp;quot; images from me.  Oh but WAIT!  I'm not selling them.  Sooooo......you're thanking him for calling people a thief?  Next time I'm at Wal-Mart and someone shouts &amp;quot;Fuck you that was MY loaf of bread, you took it out of my cart you thief.&amp;quot;, I'll tip my hat to them and say &amp;quot;Thanks for the heads up!!&amp;quot;&lt;/p&gt;</description>

&lt;p&gt;I think you are right.  Most went to the booth for a purpose.  They wanted a photo to give a new boyfriend, or to record the acquisition of a new hat.  They often went because they didn’t want to be embarrassed by confessing their silliness to a photographer.  And a lot went because it was cheap and very rapid.  Prints in minutes.&lt;br /&gt;
&lt;br /&gt;
Sometimes it was a whim when two friends were enjoying a midway.  They could trade pictures and commemorate the day’s fun.&lt;br /&gt;
&lt;br /&gt;
Some were actually for business purposes.  A snap was needed to attach to an application.  Actually I believe early on, they could be used for a passport photograph, as regulations were rather haphazard back then.  Not so now.&lt;br /&gt;
&lt;br /&gt;
I find so many however with a little inscription on the back.  Often it is something like: “To Jack, with love, Sarah.” Or “Your friend, Maude” They didn’t want to be forgotten.&lt;/p&gt;</description>
