Back to Ningaloo HQ to check everything is ok with the Phantom after a
stupid take-off crash in the Vale lanes. After an apparent half hour
of self diagnosing (according to the light code), all was well.

I’ll bet quite a few flickr-ites have had some sort of experience like this – being approached by someone with a company, non-profit or other organization that would like to use a particular photo. I’ve granted permission in the past – without compensation – to some non-profits, schools and such. Have had at least one transaction with a commercial outfit and they agreed to make a one-time payment for usage, for a royalty free licensing arrangement. I probably should’ve charged more in that case, but when all this is new and one is basically an amateur, how do you know what’s reasonable?
Anyway, I was approached a few days ago by a clearly commercial party. The woman’s request read in part as follows:

"Specifically, I'd like permission to use the following image (the one above) in the HouseLogic article ‘Season-by-Season Lawn Maintenance.’
The image may also appear as a link back to the article in such places as our email newsletter; social media, including Pinterest; marketing; companion site for REALTORS®; and website home page. The use may require that we resize the image to fit the size constraints of our website.
We’re asking you to grant the National Association the non-exclusive, royalty-free right to use the image as described above for as long as the topic is included on our website. We would include a credit to you in the caption accompanying the image in its primary locations on HouseLogic. If you would like, we could also link that credit to your website.”

As you might notice, there was no mention of any compensation.
I did some beating of the bushes to see if I could determine, just for grins, what kind of licensing fees are involved if one goes to a large outfit like Getty Images. It gets complicated, because they factor in a lot of variables and then a program spits out what the fee would be. But, they also have set fees for particular types of usage, and about $200 seemed to be a basic price for limited usage of a fairly small to medium size image.
So, I replied to the requester that, “I don't grant usage permission for commercial users without compensation. I don't have a ready made rate schedule, since this type of request doesn't come up frequently. The short answer though, is: if you aren't prepared to provide compensation, then my answer would be no.”
I didn’t hear anything further from the woman.
As part of my beating the bushes, I had perused their website and saw that they are using a number of images from “ordinary folks” like you and me. They credit the photographer but I suspect they didn’t pay anything for the usage rights. My take on this is that it’s a thinly veiled ripoff, taking advantage of amateur photographers who, in many cases, have just as good a quality of photo to offer as the big stock photo services.
My suggestion to others is this: don’t be a pushover. Let’s not let the big-time operators take advantage of us (for their profit) by offering nothing more than a measly credit line under a photo, or a link back to our flickr account.
