UVic admits, in their own documentation, that Bruce Dean was never observed to be impaired by marijuana;

"...the initial assessment was based on second hand information and that it was not made by visual assessment."

"...at the initial time of decision making the student [Bruce Dean] had not been observed officially. That Dan had made his decision based on the information Doug [Smith] had told him."

(Doug Smith is a UVic employee who used to work at a business that supplied me parts for my mobility aide, and through this he became aware of my medical marijuana license.)

I wonder if anybody thinks this is the proper way to assess marijuana impairment; without observation, based upon the existence of a Federal Marijuana License, and the word of a narc who was admittedly impaired by narcotic pain killers;

‎"...she [Jenny Wooding] was outside with a couple of students that were smoking weed (she was just present not partaking) and compared her impairment [from narcotic pain killers] to theirs and found it to be about the same. She then encountered Bruce in class and claims that he was far more impaired than she was."
(this narc's info didn't surface until after UVic had made their assessment of my impairment)

‎"Dr. Dyson said that there is no professional at University Health Services who would be able to judge dosage levels and behavioral effects" - but no worries, they've got Jenny Wooding on Narcotics and Doug Smith on Federal Licenses.

I was never stoned in the workshop. I was never seeking permission to be stoned while operating heavy machinery. I just don't think it's okay to subject me to scrutiny simply because I have a medical marijuana license.

- Guilty Until Proven Innocent -
In spite of, or because of my prescriptions, and Federal Marijuana License; the BC Human Rights Tribunal assumed, like UVic, that because I have a Federal Marijuana License, I must be impaired, or need to prove that I am not.

I am allowed to drive a car but I am not allowed to make a sculpture in art class.

"...the University determined that there was no professional on campus who was qualified to judge dosage levels and the physical and psychological behavioral effects of marijuana in respect of the contemplated risks. University administrators concluded that the University should seek documentation from Mr. Dean's physician confirming that Mr. Dean could operate the heavy equipment in the shop without posing an undue risk to himself or others."

I never asked my doctors for the letter, but I did discuss it with them, and they agreed, it was an impossible request, which, if granted, may make them liable in the court of law. They don't know what other medication I may have taken on any particular day, or how tired, or distracted I could be, or sick with a cold, or hungover, or...

"In refusing to provide the requested medical information, Mr. Dean has failed to establish that his use of marijuana is pursuant to a bona fide medical prescription or relates in any way to his physical disability."

"...a complainant must establish a prima facie case. Mr. Dean cannot successfully do that without providing a medical connection between his disability and his consumption of marijuana."

I am appealing the decision.

Human Rights Tribunal progresses. Does the University have the right to pull a disabled student from class because of their medication, even if they aren't using the prescribed medication? If so, what medications should be included on this list? Should we screen for drug and alcohol addicts? It's Medical Marijuana Week, I hear, but while everyone celebrates and advocates for marijuana, this medical marijuana patient, disabled University student is battling the good fight alone. Hmmm...

I've been before the Human Rights Tribunal before, successfully winning rights for medical marijuana users.

The University of Victoria, aware that my disability related legal medication is marijuana, pulled me out of class and I had to speak to the head of the department.

The University wanted documentation regarding my medication, over concerns for public safety.

I told them I would provide the documentation, if they could prove to me that this is standard procedure for all legal medications that students take, if not, this is discrimination and it will be handled as such.

No word back yet, but they asked me to stay away from other students to ensure that I am not placing them at risk; and they banned me from class, for what turned out to be a month.

...and so, I'm off to the Human Rights Tribunal, WITHOUT THE SUPPORT of the Victoria's International Hempology 101 Society, a group that advocates for the rights of of marijuana smokers through Cannabis Activism. Hempology 101's Ted Smith had originally offered support, but after speaking with the University, the support was no longer availible.

Bus driver for bus #11 held-up the bus trying to eject me. He insisted I leave, because he could smell the shipment of medication I had just picked up. I informed him that I was disabled, and the marijuana smell he was scolding me about is my medication. I told him that if he wants me to leave the bus, he will need his supervisor or the police. He continued on after an extended wait at the bus stop.

None of the passengers would look me in the eye or smile at me. I was evil, for sure. For several stops he would stall while staring at me in his mirror, and then he'd say out loud, "It's not worth it to inconvenience the other passengers", and then he'd drive on, further pitting me against my peers. He constantly stared at me in the mirror, so much that he missed picking up a young lady at a bus stop near Central Middle School here in Victoria, BC; he just blew right by her staring at me, not the road.

"Funny" thing is, this happened in the middle of Greater Victoria Anti-Stigma Week: Drug Use, Dignity and Human Rights; while I'm awaiting a Human Rights Tribunal meeting over the University of Victoria ejecting me from classes last term because of my medical marijuana -- not smoking it, just because I have the license.

I reported this incident to BC Transit, but days later I still haven't heard back.

In 2009, RMRM released their eponymous debut album which was supported by a nationwide headlining tour spanning 13 dates in 6 provinces. The entire first pressing of 'Rocky Mountain Rebel Music' was sold out by the time the band wrapped this first tour, in Quebec City.

Known for mixing up their sound with numerous instruments such as Violin, Didgeridoo, Space Drum and often working with other local artists and musicians, RMRM never plays the same set twice! The band has also worked in collaboration with Victoria hip-hop group The Pocket Kings on the track “Light It Up” as well as playing a series of successful shows as an 11-piece hip-hop mashup. These rebels are notorious for their high energy, open air guerilla concerts, parties, and overall support and involvement in the Victoria music scene.
